1. What this page covers

ScentMax is run by SMStudios LLC. Members build the collection entries, write the reviews, and log the wears. We host what they post.

This page is the route for copyright problems with any of that. It covers how to get infringing material taken down, and what to do if something of yours came down and should not have. We follow the notice and takedown process set out in the Digital Millennium Copyright Act, 17 U.S.C. § 512.

2. Reporting infringing content

Email is the fastest way to reach us about this. Instagram messages and App Store reviews are not. If you need a postal address for a formal filing, ask and we will send you one.

17 U.S.C. § 512(c)(3) sets out what your notice has to contain. Include all of it:

  1. Your signature, typed or handwritten.
  2. The work you own. If there are several, a representative list is enough.
  3. Where the infringing material sits on ScentMax. Give us the username plus the specific review, image, or fragrance entry, and a screenshot or link if you have one.
  4. Your name, mailing address, phone number, and email.
  5. A statement that you believe in good faith the use was not authorized by you, your agent, or the law.
  6. A statement, under penalty of perjury, that your notice is accurate and that you own the work or are authorized to act for the owner.

Leave any of it out and the notice may not be legally effective, which slows things down for both of us.

3. What we do with it

We review each notice we receive. When one checks out, we take the material down or block access to it, and we tell the member who posted it, passing on your notice so they can respond if they think we got it wrong.

Because members enter most of this by hand, pointing us at the exact entry matters. A brand name on its own is usually not enough for us to act on.

4. If we removed something of yours

Takedowns are judgment calls and we will occasionally get one wrong. If you had the right to post what we removed, send a counter-notice to the same address. Under 17 U.S.C. § 512(g)(3) it needs:

  1. Your signature.
  2. What was removed, and where it sat before we removed it.
  3. A statement under penalty of perjury that you believe in good faith it came down by mistake or misidentification.
  4. Your name, mailing address, and phone number.
  5. Your consent to the jurisdiction of the federal district court covering your address, or, if you live outside the United States, any district where SMStudios LLC can be found, and your agreement to accept service of process from whoever filed the original notice.

We pass valid counter-notices back to the person who complained. If they do not go to court to stop you within 10 to 14 business days, we can restore the material.

5. Members who keep infringing

Under 17 U.S.C. § 512(i) we terminate the accounts of members who infringe repeatedly. Depending on what happened, we may remove the content or suspend the account instead.

6. False claims

A takedown notice is a legal document. Under 17 U.S.C. § 512(f), knowingly claiming material infringes when it does not, or knowingly claiming a removal was a mistake when it was not, makes you liable for the damages and legal costs that follow.

Get advice first if you are not certain you hold the rights.

7. Fragrance names, brands, and bottle photos

Our catalog names real fragrances and the houses that make them. Those names and logos belong to their owners, and we use them to identify which fragrance is which, nothing more. ScentMax is not affiliated with, endorsed by, or sponsored by any fragrance house.

Catalog images are a separate question. If one of ours reproduces a photograph you own, send a notice under section 2 naming the fragrance and we will pull the image. If you are a house that would rather we used your own product photography, tell us.

8. Trademarks

The DMCA is copyright law and does not reach trademarks. For a trademark issue, email the same address with Trademark Complaint as the subject and tell us the mark, its registration number if it has one, and what on ScentMax you are objecting to.
